A Federal High Court sitting in Warri, Delta State on Tuesday adjourned a
suit filed against the Independent National Electoral Commission, INEC,
to February 24, 2015 over its decision to suppress two constituencies
in the state.It was stated that the court had on October 31, 2014,
ordered INEC to restore forthwith, Ughelli South 1 and Isoko North 1
constituencies of Delta which was suppressed by INEC in 1998.The counsel
to the plaintiff were, Mr Efe Akpofure (SAN) and Mr John
Okoriko.According to Tribune newspaper report online, Justice Shittu
Abubakar gave the February 24 adjournment to enable that INEC is served
with necessary notices and speed up the hearing.Counsel to INEC, Mr
Olufemi Adeyemi, had informed the court that his client (INEC) ,was not
served with a notice as claimed by the plaintiff.It
will be recalled that INEC was dragged to court by Mr Felix Onowakpo and
Mr John Ewenede, for its refusal to execute the October 31, 2014 court
judgement.It was gathered that instead of the electoral body to
implement the ruling, it filed for a stay of execution against the
judgement in the same court but was, on February 3, eventually dismissed
by Justice Abubakar.Meanwhile the Independent National Electoral
Commission (INEC) has denied reports that a replacement has been chosen
for the chairman Prof. Attahiru Jega.
