Ebonyi 2015 Judgements: PDP Continues To Shine As Tribunal Affirms The Election Of HON. Lazarus Nweru Ogbee

As was with the election petitions against Senator Obinna Ogba, Dr. Sam O. Egwu, and Hon. Linus Okorie decided yesterday in favour of all the PDP candidates, the PDP continues to shine in Ebonyi
State today as the Justice J.F. Agya-led National/State Assembly Election Petitions Tribunal sitting in Abakaliki, Ebonyi State, has just a few minutes ago delivered its judgment in the election petition of Hon. Tobias Chukwuemeka Okwuru dismissing the petition and unanimously upholding and
affirming the March 28, 2015 election of Hon. Laz Nweru Ogbee as the member representing Ikwo/Ezza South Federal Constituency in the National Assembly (House of Representatives). The Tribunal had earlier struck out paragraphs of the petition for being imprecise, vague, lacking specificity and particularity, and for not joining as parties the names of persons against whom criminal allegations were made in the petition. The Tribunal also rejected the two reports of Hon. Tobias Chukwuemeka Okwuru's expert witnesses and expunged their written statements on oath and all evidence elicited from them during cross-examination on the ground of having not been filed contemporaneously with the petition within 21 days from the date of the declaration of the result of the election. The evidence of the petitioner's first witness (PW1) was also struck out because there were no facts on the pleading to support his evidence. After expunging the evidence of Hon. Tobias Chukwuemeka Okwuru's two expert witnesses and PW1, he was then left with only his evidence which was to the effect that the election was free and fair in his polling unit. Like a pack of cards, the petitioner's case simply collapsed due to lack of evidence.
